Ted Wafer – Guilty of 2nd Degree Murder

Wanted to get this posted ASAP. Plus, there are tears in my eyes and I can barely hold them back to see to type.  Today, truth found its way into justice and refused to budge.

      The jury reached it sooner than I expected. I’m actually glad. Now, the jurors can go home. Wafer can go to jail. Renisha’s family can take a sigh and know justice was served.

          I don’t know if the verdict will cause people to think twice before killing someone, but it certainly should make them think twice about the story they’ll going to tell as to why they shot.

          • Truly sad, tell the story “right” and get acquitted. Never mind the value of another person’s life.

            According to their philosophy of thinking, the Jordon Davis’s, Renisha McBride’s, Trayvon Martin and lets not forget Ferrell all were in a public space not privileged to them. How unreasonable can that thinking be?
            All were either minding their own business or seeking help.
            I whole heartedly believe these cases make a difference of location. Sad to say, but Sanford, Fl demographics are made up of “unreasonable” people.

    • I didn’t maintain myself……….so there !! And slowly the Deputies surrounded him.

      I was concerned when the jury wanted a tape measure. I just thought that one of them would make a big deal about shooting someone from inside the door at a distance of 1 ft. – 2 ft. – 3 ft. or whatever and make the ridiculous claim he was going to be attacked since she wasn’t across the street or something.

      But GUILTY inside of 1 day of deliberation.

    Xena, Now that this trial is over, I think it is time to take a short break to get mentally prepared for the Dunn trial in Sept. I want to thank you and Yahtzee for all the work you did to keep us abreast of the events of this trial and also having patience with this hard headed, some times overbearing old moth amongst a flock of beautiful butterfly’s! I failed to mention this, actually did not do so because of the emotions it would have brought out, How many of you realized on that cold and rainy morning Renisha McBride was wearing a hoodie? I’m not leaving, just going to take a break to deal with problems on my end… Hoods up!!!

      Because of the trial and medication that doesn’t want me to stay awake, I have lots of catching up to do. There must be at least 100 new posts on blogs that I follow that I’ve not visited yet, and I hope to catch up with that before the weekend is over.

  17. great to finally see justice in one of these horrible murders. this case was tried strikingly different than zimmerman, even with the beginning introduction of the drinking stuff, but I felt the state was doing that to let the air out of anything the defense would bring in about it later. and it seemed to work because the defense couldn’t really say much more about it during their case w/o sounding desperate & redundant.

    the state did their job by calling out the defense attnys lies and tricks. how refreshing.

      YES! The prosecutors made Renisha real. Wafer killed a real human being who was only 19 years old, injured and bleeding.

  18. oh happy day! i wish the verdict video had shown wafer being cuffed and hauled away, but am so pleased with the verdict, i’ll let it go. may this serve as a grim reminder to self defense fantasizers that you can’t always get what you want.

          True, but as the Rascals sing in one of their hits from the early ’70’s, “as long as there is a ray of hope, Lord I don’t mind going out doing my work. Light up the way to brotherhood.”

          Trayvon will always live in our hearts and there is still the DOJ decision on whether Zimmerman violated Trayvon’s civil rights. There’s still hope and even if that candle goes out, we shall light another one.

  22. WOW! Michigan law v Fl. It sure would be wonderful if other states would roll back their laws to follow Michigan’s. That is how civilized nations are. We cannot allow ourselves to become the Wild West. There was actually a time and only about 5 years ago that tubs would have also gone to jail for at least second degree.

      I think the conviction was due to the pros “forcing” Wafer to take the stand, and the jurors using “common sense,” something IMO the jurors in tubs case seem to be lacking.

        2dogs says: it is never encouraged for a defendant to take the stand by most, if not all good defense attorneys. And is a defendant’s constitutional right to refuse and supposedly jury is instructed on that.
        So, I didn’t follow the case and really should not make any comments. But apparently Michigan does have SYG in public places which leg. Is trying to roll back.
        Florida was the first to pass this in 2005. Go sunshine state. ;-(

        Wonder why he took the stand since he’s protected under constitution from doing this. Most, if not all, defendants cannot begin to meet a seasoned prosecutor’s skill. Some try, like wafer and Utah lady. Big egos make them think they can present their defense. Huge mistake almost without exception.

    What was the felony firearm charge? I never heard about this one. Was he a convicted felon? or was it an illegal shotgun?

      I just looked it up and I think he was guilty of it because he operated a firearm in a manner not allowed by law.

Firearm charges might also be filed against individuals who purchase a firearm for a felon or who operate a firearm in a manner not allowed by law.     Post for RACERRODIG . The Financial Times had an article last week saying “Lawsky had re-opened Occum ( sp.. Sorry) investigation. I didn’t know how to contact you but I think it was you whom had been trying to get some justice. Maybe google “FT and Occume and Lawsky”. I think the Financial times is out of London.     • 2dogs……..Ocwen is the co. we sued and have been victimized by along with Deutsche Bank and several others. One of the frauds involved insurance which is what the Lawsky investigation is about. I sent a summary to my lawyer today and this will help us quite a bit as it shows a continuing pattern of massive fraud.

    There is this interweb rumor that the charges against Wafer are up in the air as to M2 or Manslaughter sentence.
    Certain charges a defendant has are a leading charge (top charge to be at sentence decided). The sentence is based on the charge he was found guilty of, the other charges face the same element of any other sentencing. Wafer will be sentenced with 2nd degree murder within his States limits, plus the added charges he has been found guilty of which is why I celebrated the additions the other day.
    Wafer will not be alive when he is free from officially serving his time.

    I suspected the juries request for items was a very logical result that they paid close attention of what had happened & it was not as Wafer portrayed. Good for Michigan. They have enough senseless porch killings!
    If the US begins to sentence death to DUI´s… Houston we have a problem.

        I have to correct this.

        Upon further study, he can not be sentenced to both M2 & Manslaughter. The Manslaughter was added as a lesser charge. Due to what is called the merger doctrine (or double jepordy) he can not be sentenced for the lesser charge unless it occured as two seperate events in the same case. It makes sense. Wafer either had acted with malice & intent (M2), or w/o malice & w/o intent (Manslaughter).
        The Judge does have discretion in what she can sentence Wafer to in terms of years for M2. Although she must follow the State sentencing guidelines. Michigan law is “any term of years up to Life.” Michigan also allows judicial discretion to migating and aggravating circumstances. The State will have opportunity to recommend a sentence. The Defense & Wafer will have opportunity to plead for leniency.
        Renisha´s family will have opportunity to give a victims impact statement.
        As for the firearms charge it runs consecutive and must be served prior to the clock ticking on his M2 sentence. (MCL 750.227b (1))
        But Wafer is now a FELON. He can never again legally own a firearm.

        I am guilty of listening to an internet rumor. I apologize for misinformation in the above comment. 😦

          Thanks for the humbling correction. Since each state has its own law and sentencing structure, it’s not always easy to know what to expect.

          In the video excerpts of the trial, I saw the judge taking notes during Wafer’s testimony and figured she did so in the event he was found guilty so she would refer back to them for sentencing. IIRC, she did that also when he blamed EMS for not showing up at the accident scene before Renisha left.

          Even if the judge’s discretion decides to sentence Wafer to 19 years without parole, (a year for each year that Renisha lived), he would be 74-75. If he gets parole, he could collect social security and move into a retirement home, be jumpy, and required to keep the door to his room open and not closed so no one would need to knock. 🙂

    Please forgive me if you all have seen this video. I hadn’t – and it’s un-fricken-believable!

    If there were any doubts about Wafer’s credibility, this gives a peek into what the jury saw, and it’s un-fricken-believable! It’s a portion of Wafer’s direct exam by his lawyers. It’s downright funny. His lawyer keeps asking him, “So what do you do…?” And you can’t help but recalling Clint Eastwood from whatever that movie was. But compounding that, Wafer gives his ANSWERS in a Clint Eastwood voice from that same movie. So, it’s like … Wait!! The Clint Eastwood voice is coming from the wrong role!

    Worse yet, Wafer WAY overplays his part! No wonder the jury didn’t believe this guy! It’s like watching a painfully wretched, low budget wanna-be movie! And this video only shows PART of his testimony … but it’s enough to let you know that you didn’t need to see it all.

    Un-fricken-believable … literally!

      Know the impression I got of Wafer while he was testifying? That’s he’s used to talking to women who he has let down, betrayed, or lied to, much like addicted people do when trying to convince someone to be their enabler.

  34. Thanks Xena for keeping us informed on this murder.
    I live in Houston and remember hearing about someone being killed, but after that I don’t remember seeing any more about it. Seems like it was shortly after hearing about the young man trying to get help and was murdered.
    I can’t understand why there hasn’t been any coverage here, but I believe it’s best for
    it not to be tried in public.
    Kids used to believe that they were safe if they could get an adult to help them. What a shame. These “adults” really do care about their guns more than they do about a child’s life.
    Didn’t this idiot say his phone was in his pocket?
    If I’m not mistaken there have been at least 5 murdered and none of them were a threat in anyway nor did they have a weapon.
    Thankful he got charged with 2nd degree and other charges as well.
    Hope he does spend the rest of his life in prison.
    He admitted he took a young girls life. I hope that haunts him and others like him for the rest of their lives.
    There is nothing more precious to us than our kids!!!

      Yes. Overall, I think the jury was wise of the strategy of “victimizing the victim” and also the dog whistles of “changing neighborhood.” Diversity in juries is necessary, which is something we did not see in George Zimmerman’s trial. This is not to say that a diverse jury is biased, but that it leans to having jurors use unbiased common sense. Common sense says that no one opens their door if they are afraid and think there are multiple individuals outside trying to break-in.

          It appears that jurors from urban areas have more vast experience to use common sense. Small, southern counties like Seminole County, FL. are very limited in getting a jury pool consisting of people who experience diversity. For example, we heard from Maddy, Juror B29, originally from Chicago, who said her first vote in Zimmerman’s case was 2nd degree murder.

          In the end, it wasn’t because any of the jurors believed in Zimmerman’s innocence but rather, they blamed their verdict on their confusion of the law. Intelligent people do not protect their egos — they ask questions and if the answers do not help, they use common sense.

          The thing that stood out to me in Dunn’s trial is that in spite of him saying Jordan threatened him, he also said that Jordan was getting back in the SUV when he fired. Using common sense with Dunn’s story, it means that Jordan was retreating and Dunn had no reason to shoot. The rest of his story is therefore moot — no need to determine if he’s lying. The law does not allow him to shoot when he is no longer under threat.
