Complaint Filed With Florida Bar Against Mark O’Mara

Rene Stutzman of the Orlando Sentinel reports that she has confirmed that a complaint has been filed with the Florida Bar alleging ethnic violations by Orlando attorney Mark O’Mara.  As of now, who filed the complaint and specific allegations are not known.  However, the Florida Bar has confirmed that its staff is investigating.  The complaint is related to Mark O’Mara’s handling of George Zimmerman criminal case.

Mark O’Mara took on representing George Zimmerman in his case of second-degree murder for the killing of unarmed, 17-year old Trayvon Martin.  That representation got off rocky as O’Mara represented to Judge Lester that Zimmerman should be given a low bond because the Zimmerman had no assets.   The State subsequently produced evidence before the court that before that bond hearing was held, Zimmerman had received almost $200,000 in donations through a PayPal account.

Mark O’Mara also presented to the court that he had turned in George Zimmerman’s passport.  The State subsequently produced evidence that Zimmerman has another passport, a valid and current one, that his wife had placed in a safe deposit box.

Mark O’Mara took over the “legal defense fund” and obtained a “Trust administrator.”  Some of the administration later changed, as O’Mara said that George Zimmerman appointed another Trust administrator.  O’Mara did not provide details.

The PayPal account for the “George Zimmerman legal defense fund” has been closed for about a month.

It has been reported that Mark O’Mara used money donated to Zimmerman to upgrade his offices with computers. Also, Mark O’Mara and co-counsel Don West formed a company that purchased a building next door to O’Mara’s office, and leased the building to O’Mara, who paid the rent from money donated to Zimmerman.  That building was said to have been used for the exclusive purpose of working on George Zimmerman’s defense.

Since Zimmerman’s acquittal in the murder case, he has had several run-ins with the law.  O’Mara announced that he would not represent Zimmerman in any new criminal cases, neither the divorce case that George’s wife, Shellie, initiated.

According to the Orlando Sentinel, the Florida Bar reported today that neither Assistant State Attorneys de la Rionda nor John Guy currently face ethics complaints related to the Zimmerman case.

  6. Roderick mentioned on the other article about Juror B37. I figured posting the video here would be appropriate. It’s the longest video I’ve put together but was necessary to show the pattern of O’Mara’s voir dire of potential jurors.

    What I presented in an article posted on 3chicspolitico is that O’Mara had only been given a general description of the stealth juror; that he did not know her before she appeared for voir dire. The questionnaires were designed to narrow down potential jurors, assuring that the stealth would be voir dired within the first few days.

    When hearing O’Mara’s voir dire of Juror E40, there is reason to believe that he thought she could be his stealth juror, and I suspect that E40 and B37 might be physically close in appearance. Juror E40’s answer to O’Mara’s question about what she would tell other jurors was not the proper response letting him know she was the stealth.

    Juror B37 gave code words during her voir dire, and also revealed things about her personal life without being asked. O’Mara did more than question Juror B37. He actually gave her instructions on what she was to do in the jury room and what she was to tell other members of the jury.

      I actually think the complaint has come from George Zimmerman at the advice of his NEW attorney.. I would almost bet that it involves an effort to recover the money paid to settle the law suit that MOM and Shellie settled on and the money allegedly was taken from the trust fund… Hang on and watch George Zimmerman now stick MOM and Shellie with that settlement and end up with the money from the trust fund in his greedy paws… I’m surprised someone has not come up with a soap opera for television based on the life of George Zimmerman…

        Back around December of 2012 I observed O’Mara in court with Zimmerman and said then that he probably regretted ever hearing George’s name.

        It’s been about 6 months since O’Mara wanted to put Bernie de la Rionda on the witness stand, and Judge Nelson continued the hearing. Now I’m wondering if the former employee who opened that door and who is suing Corey is the person who filed the complaint. Inquiring minds want to know.

He is so disingenuous when he tries to act as if he just cares about “keeping communities safe” but in reality he knows damn well Zimmerman just shot the kid because he felt like it. And he took on this case to raise his national profile, and indeed it has… but possibly not in the way he was hoping lol

      I agree. That is why he and West argued that jury instructions be written to eliminate the initial aggressor part of self-defense law.

          Caleb, I think you’re right. Zimmerman setup that Paypal account and Facebook page begging for donations for a “legal defense” before he was arrested.

          Remember the guy who offered Maddy, Juror B29 a job with his outbound telemarketing company? Wonder why he didn’t offer Zimmerman a job or why Zimmerman did not ask him for a job? I mean, he certainly can’t say that his voice can be recognized over the phone by strangers who never heard him scream before, right? (snark)

        Xena, the sad part is if you connect all of the the police interviews George basically admitted he murdered Trayvon and only due to the combined effort of Sanford PD, Judge Nelson, and Angela Corey and her minions, and Juror B37 that George got away with murder.

        But karma will pay him back a million times over for murdering Trayvon just because he could.

        • Roderick2012, I know that some disagree with me, but I don’t see any pre-planning by the prosecution to throw the case. They had a road map and O’Mara threw them off that road map by using cultic methods when cross-examining, cheating (Donnelley), and interfering with the State’s rebuttal case by arguing the case of assault against George was “old.”

          On the other hand, Judge Nelson rushed the case because she had a sequestered jury. It was a good excuse to not allow a recess for the State to get a rebuttal case arranged. She also allowed the re-writing of pattern jury instructions that effectively removed the initial aggressor part of self-defense law.

          I also put all blame for the jury’s decision on Juror B37. Her interview on AC360, and her former literary agent’s release of info, are very revealing of Juror B37’s biases before she even received summons to report for jury duty.

          • Thanks, Yahtzee. There are things that I think prosecutors could have laid out and drove home, but they stayed within the rules and customs. It was West who went waaaaay overboard taking up time. His diatribes and regurgitations during cross-examinations were intended to take up time to shorten the time for the prosecution.

            Don West appears to be the type of abuser who would wake up a sleeping person to ask the same question for the 100th time.

          • Xena, during the whole trial we kept saying wait till they bring in the FBI, the science the timeline, the phone records. then after state’s case and while they fumbled through the defense 100X, we kept saying wait for the rebuttal!
            but when they didn’t have a rebuttal,i freaked out! even i knew that was not normal! what in the world stopped them? how does a state try a murder case, especially as important as this, intending to win it but never prepare a rebuttal! just no way!! who cares about that 1 witness, they could’ve gotten it in if they wanted.
            but what about all the science? where were the investigators (w.credibility) to actually go over the evidence that proves zimmerman was lying about everything! that he was NOT going to the store, that he did not just finish “mentoring the kids” and he sure didn’t have dinner w.wife?

            I know. That was a great disappointment. I was waiting to hear the evidence as Gilbreath and Guy stated pre-trial. It didn’t come and I don’t know why.

            After watching SA Martinez in the Jodi Arias trial tell the jury what Travis did and felt as he was being slaughtered by Jodi, I expected Bernie and Guy to do the same in their closing. Yet, with the revealing of Juror B37’s biases, I don’t think anything that the prosecution did would have made a difference. Just look at all the evidence that Juror B37 disregarded, while Juror B29 said that the evidence proved Zimmerman murdered Trayvon.

            There is an article that I cite often when trying to show the Zimmerman supporters how the State threw the case, but I am just going to agree to disagree with you on this issue.

            I have a question of standing in a criminal case. Since the trial was the State of Florida vs. Zimmerman does that mean any legal resident of FL would have standing to file an ethics complaint against O’Mara?

            As for Piglet moving to Texas, is it possible that he ran across some white supremacist types during his victory tour who agreed to hide him in case the Feds filed charges against him?

            Those types are just itching for an excuse to use their weapons against the Feds. Another Waco?

            I remember during jury selection that O’Mara complained about the State dismissing potential jurors, and that there were all White women. I do believe that the State made a mistake when it did not dismiss Juror B37 for calling peaceful protests “riots.” Then too, we don’t know what was argued when the attorneys went to the bench.

            There is an article that I cite often when trying to show the Zimmerman supporters how the State threw the case, but I am just going to agree to disagree with you on this issue.

            One of the things I’ve wanted to do since the verdict was have discussion of what prosecutors could or should have done at trial, and how the defense cheated and lied at trial. That in fact, I had started taking cuttings of clips of video from the trial to focus on issues for discussion. But then, Juror B37 opened her mouth, followed by Juror B29, then Shellie filed for divorce, George was stopped for speeding, etc.

            I often hear people say that the State threw the case, but there are no specifics or just partial specifics. I’d like to discuss the specifics. Who knows? I might change my mind.

            I’d have to read the Florida Bar rules to see if they give an answer to your question. The last time I visited their site (which was many months ago), I remember reading something along the lines that clients, attorneys, and judges can file complaints. They also said that at times, the Bar will open an investigation due to something printed in the media about an attorney.

            Actually, Florida has a fairly large population of White Supremacists and sovereign citizens. But, maybe George thinks it would be safer to hide out with snakes rather than alligators and snakes.

        This bidding pattern is very odd for Ebay. Usually people “snipe” bid in the last 10 seconds of the auction….that is when they put in the super high bids.         • Yahtzee, A couple of small points that have not been discussed that are important about this part of the George Zimmerman saga. The first that has not been mentioned is that this sale will be considered income for Zimmerman and taxes will have to be paid on the funds received. The second point that most will not consider is that this whole transaction reeks of money laundering, perhaps not for the benefit of George Zimmerman… IMO this whole (alleged sale of paintings) episode raises a red flag much like the phone calls he made to Shellie while in jail…. Perhaps I am wrong, but IMO this will bring attention to him that is not the type he really desires. Then again perhaps one of his former supporters has found a way to dispose of his former hero in a way that does not involve race, that would allow the gun lovers a way to save face for supporting a Non White against a Non White… Ahhh, racism at it’s lily white best… Is it possible that Georgie is being set up by one (or more) of his former supporters??

  11. At the time of his arrest in November, Zimmerman was ordered to surrender his cell phone, two handguns, a shotgun, and a AR-15 rifle. Since the charges have been dropped, Zimmerman is eligible to have the weapons back, but according to the Seminole County Sheriff’s Office, he has yet to pick up the items.

      IIRC, George Zimmerman and Jahvaris Fulton have the same birthday.

      The case has been very significant for this country, bringing people together in unity of compassion, love, and justice for all, to the extreme of bringing White Supremacists out in the open.

    • Marilyn, you make an excellent point. Tracy Martin, Sybrina Fulton, and Lucia McBath are advocating for others. I lost count at the number of scholarships that Trayvon’s parents have awarded to others.

      Now with his experience with Trust funds, George could have gone to a professional and organized a not-for-profit to raise money to help others with living expenses while awaiting trial. He could have been a paid spokesperson. Instead of planting seed money into such an effort, he bought guns — lots of them.

He and his sock puppets used the comment sections as chat rooms.
