Starting from point A.

Justifiable use of force by the aggressor is not available to a person who initially provokes the use of force against himself.

If not but for the fact that George Zimmerman, (who was armed with a fully loaded gun), got out of his truck to follow 17-year-old, unarmed Trayvon Martin, the two would not have come into physical contact.

    • @MMPat. I agree. GZ could have faced the music with a charge of unlawful retainer, but he did not have to take Trayvon’s life. Testimony at trial of DNA evidence shall prove that Trayvon didn’t punch neither smother GZ, nor bash his head on anything.

  2. mmp & Xena……For the life of me, I cannot fathom, even knowing Fogen is a mental midget, what causes one to do something like this. To kill anyone for the horseshit reason we know was his motivation and to claim the last words of Trayvon as his own……….

    I know when Fogen gets settled into hell, even Satan will be pissed…….and then it will get ugly. Then when Moron O’ Mara joins them, there will be no Motions to file on this agony.

Angry that he lied about it being a justifiable homicide. Angry that he lied about donations making it reasonable to believe he planned to flee.   3. This GZ is one stupid dude. Sean is watching his GPS enabled E911 monitor and he see’s GZ moving rapidly after saying that Trayvon ran. Sean says “Are you following him?” as a way of trying to make GZ recall his tour of the E911 call center, and perhaps remember that all cell phones are GPS tracked. GZ doesn’t pick up on it, or may be he does, but doesn’t think that the GPS data is also recorded. So he say “Yes I am”, so Sean says; “We don’t need you to do that”, GZ says “okay” but he continues to move. My guess is Sean is now watching the monitor and he sees that GZ is not about to give up the hunt.

    My guess is that at this point Sean get’s antsy and taps the trace lock key, meaning he will now keep tracking the phone, even after the caller disconnects. Then he offers GZ a little warning: “So I’ll have the officer meet you at the clubhouse?” GZ comes back with: “Could you have them call me when they get here? Then I’ll let them know where I am?” Sean tries one more time to wake GZ up by replying: “Okay I’ll let them know where you are when they get there!” [but not in so many words]. GZ doesn’t take the cue and stays right on the hunt.

    This is probably why the first 911 call doesn’t go to Sean’s terminal, because he’s still tracking GZ, so the software sends the incoming calls to other terminals first.

      • Sure, just imagine a screen in front of the courtroom with the image of GZ’s phone moving rapidly south of the tee towards Trayvon’s house. Then turning to suddenly start racing north. That would have been it, no more beg-a-thon, no more office renovation, no more perks. Worse yet, as far as I can tell, after such a tape played, there would be no more bail either. Unless I miss my guess from what the Professor has said, in Florida there’s a component to bail that says you can’t be too likely guilty. I read that as saying that if guilty is 90% likely then that’s a good and sufficient reason for the court not to admit the defendant to bail.

        • What the Professor shared about bond applies to establishing bond while awaiting trial. Since the court already granted bail, and had GZ had immunity denied, the State would need to file a motion to revoke bond for the court to consider.

          You are right — O’Mara realized the consequences of having an immunity hearing would stop the blood money from coming in. GZ’s supporters would see his guilt and there is no chance on a jury deciding otherwise based on the evidence.

          Actually, since GZ cannot afford to live free on bail, he should have stayed in jail. At least then O’Mara may have had sufficient money for expert witnesses rather than now using the lack of money as an excuse.

          • Yes, after an immunity hearing failure, the SP would be remiss not to move against continuing the bond. With such a high degree of guilt having been determined, it would be a danger to the public to allow him to remain free, after all, facing nothing in his future save the impending loss of freedom for the rest of his life, he’d likely turn to fixating on settling scores if any. Or Hairy Carry (hee hee hee!)

          • @Yahtzee. I admire your patience. I read your comment and several that followed. The other person, IMO, is not thinking like a concerned adult in a gated community. Not recognizing the teen, and seeing him walking in the rain, and having confidence of being NW, the first thing GZ should have done is pulled up, rolled down his window, introduced himself and asked if the teen wanted him to call someone to pick him up.

            Some years ago a friend who has Cerebral Parsley shared a story with me of how her car stopped and she was walking to find a phone, when a cop stopped her and demanded she take a breathalyzer test because she wasn’t walking straight.

            As a preacher once said, people with clean hearts and clean minds don’t think the worst of people based on sight. People with evil hearts and minds assume that everyone else is as evil as they are.

They place their courage in items rather than character. We see that with GZ. He said he was afraid of Trayvon, yet got out of his truck to follow him. His courage was in the gun.

            The dispatcher is trained to handle NW calls, remember RATL is not the only NW group in operation in Sanford. So the dispatcher is reminding GZ of the rules of NW, which should inform GZ that not to follow is for the safety of both individuals involved.

            It is a matter of record that GZ took a 14 hour course on NW, that course is the one available at the National Sheriffs Association website. So, GZ did not need to be informed of the rules, he was well aware of them, which is why he tries to explain that he got out of his truck to get an address he never bothers to use. As if that allows him the cover he needs to keep hunting for Trayvon. Well, it doesn’t work that way, it’s first things first. GZ left his truck with a firearm and followed the person he called a suspect. Even though, he had nothing to suspect that person of doing, except the fanciful idea that “he’s up to no good”.

            When, in fact, Trayvon was up to some good, he was trying to bring his little brother some candy. GZ wants us to think that Trayvon was a murderous killer, vicious, strong and highly skilled. I, for one, do not think so!

          • Like Serino says, GZ did not have authority to apprehend. GZ followed Trayvon for the reason he stated; i.e., “These assholes. They always get away.” GZ did not judge Trayvon as an individual. Rather, he judged Trayvon as a group of individuals, referring to Trayvon in the plural; “assholes.”

            The question then becomes, why would GZ assume that the kid he reported as suspicious would get away before the police arrived? Was he doing something to antagonize hoping to cause a confrontation that would retain the kid until the police arrived?

            Indeed, had Trayvon been confrontational, he would have done something to GZ’s truck to get GZ outside of it so they could fight. Trayvon was not confrontational. He ran. When he ran, GZ not only judged him to be a group of “assholes,” but he also judged him to be a group of “fucking punks.” IOWs, GZ judged Trayvon to be a coward for running.

            The depraved mind certainly applies to GZ.

          • Not to mention that in this technological age, pretty nearly everyone should be used to seeing and hearing people on hands free cell phones.

            Oh, it’s been quite a few years since I was last puzzled or perplexed by seeing people walking down the street strangely, gesticulating, seemingly talking to themselves, stopping, turning, appearing to pause and look about before continuing on. If one cared to take a closer look, it took less than a minutes observation to determine that the weirdly acting person, was actually engaged in a cell phone call.

            While GZ seems to have been able to discern that button Trayvon wore, he was unable to see Trayvon’s lips moving? Unable to determine that Trayvon wasn’t occupied with his local surroundings so much?

            That’s why I feel that GZ had to do something pretty dramatic to have gotten Trayvon’s attention so quickly after the cctv shows that he arrived at the mail kiosk. Probably flooded Trayvon with his high beam headlights, then menaced him with his tactical flashlight beam.

            As you say GZ gives Sean good reason to become concerned for Trayvon’s safety, which would be another good reason for Sean to deploy GPS tracking on the caller and keep it on him until the police arrive.

It’s one thing to try to interpret the meaning of the words someone else has used, since they could have different meanings that even the user was aware (FT’s “short term vision” anyone? 🙂 All he is doing is trying to call GZ’s hunting for Trayvon “canvassing”, but that effort fails because the term requires that he ask people for information, not sweep the area with his eyes, since that is :”surveying”.           • Ahhh Lonnie. You mean like people who argue that GZ wasn’t on NW patrol that evening, although “patrolling” is still against NW rules. Patrolling carries the idea of being outside on duty, for the purpose of providing security. That is probably why the feds questioned whether GZ had a Class G CCL. Also probably why the HOA settled with Sybrina and Tracy rather than go to court. GZ had no authority to “patrol” and no legal license to carry to weapon while he did so — that evening, or at any other time.

          • I just reread the 776 FL statute and I cannot see Fogen prevailing in any way, shape or form. I cannot fathom Corey prosecuting Fogen since the State would now have to pay his legal fees if he wins.

            I read in the law last year somewhere that the Immunity Hearing MUST be prior to the trial. Judge Nelson provided for 45 days prior. I cannot believe they would go to trial and halfway through or after he’s attempts to claim Immunity. A little help ??

          • Don’t worry, the law means what it says. JN told them she was setting aside dates so that they could have the immunity hearing at least 45 days before trial. After that time expires and they have not asked for the hearing they will be deemed to have waived. Their only remedy will be to appeal and the chances of any success there are nil. This will allow MOM to shrug his shoulders and tell GZ “that’s the way the cookie crumbles, what else can we do”?

            I get the impression that even MOM doesn’t like GZ much at all. But that has nothing to do with the case MOM is doing all that he can, he just doesn’t have anything to work with.

            What GZ needs to do is, begin teaching Shelly how to bake hack saws into cakes. 😆

      Can I use my cellular phone to call 9-1-1?
      Cellular phones can call 911 as a free call. Cass county E9-1-1 Communications Center is capable of receiving both Phase 1 and Phase 2 cellular 911 calls, depending on the capabilities of the cellular phone carrier. Phase 1 calls display the tower location and the cell phone number. Phase 2 calls display the cell phone number and the latitude and longitude of the caller within 300 meters, depending on which cell phone carrier you have. Verizon, Nextel, Sprint PCS, and US Cellular all use a GPS chip, which is accurate within 25 meters. Centennial and T-Mobile use a triangulation chip, which is accurate within 300 meters. Check with your cell phone carrier to verify if your phone has the capabilities of delivery the 911 location. All cellular 911 calls in Cass County are answered by the Cass County E9-1-1 Communications Center

      • Don’t know a bit about phone GPS systems…..My hand held for hiking gets me to within 50ft of any way point I mark……..If these GPS phones are only accurate to 300 meters……that’s 3/4’s of a football field…….someone educate me about this please

        • What they’re talking about is the older system that tried to locate by triangulating between cell towers. That went out around 2000, when the better systems using civil gps came in, they were accurate to 20 to 30 yards, but later around 2005 or so, the phone companies obtained access to military grade gps and are now accurate to within just a few feet. 3 to 6 feet. You’ll find that most security agencies don’t like to give out up-to-date information if they can avoid it. So they’ll tell you that they can’t get a location better than a few hundred feet, when they can actually watch you walk.

          Of course, if you’d been watching these things develop, as I had because I had friends on an email list who were playing geo tagging, so I managed to get updates as the systems were being improved. The geo tagging game went away or lost it’s popularity, but when I came back to look at gps state of the art, most of the information is either old, out of date, or gone.

          Of course there could be other screw ups too. Sean may not have kept a lock on GZ’s phone. Or data could have been discarded, or software glitch, area of no coverage or any other thing that could prevent them from getting the needed data. But, unless and until we’re told otherwise, I think there’s a better than even chance the data is there.

          • Lonnie. as Fogen called the NEN #, is that tracked as a 911 call would be. I just had a customer here who is a township cop and we talked about this at length. The system here tracks only 911 calls as you describe. If you call the regular number it is not tracked but is recorded. He stated some systems track all calls that come in, but is Sanfords capable ?

          • Yep Sanford tracks all calls, you can see by the document print outs that the NEN and the 911 calls all have the same screen headers on the print outs. All the terminals, NEN and 911 are all listed. So it’s the same system.

      • Is that Cass Co. Illinois? In any event the data sounds very old. They were using tower locations and triangulation way back in 2000 in the earliest systems. Sanford got it’s E911 system in 2007-2008 as part of a state wide mandated upgrade. In the years after 2000, manufacturers began adding more sophisticated chips to their phones to handle the triangulation data. That’s when it dawned on service providers that good, more reliable gps locators would be needed to drive location dependent advertising. Naturally merchants are going to pay more to get an ad to the phone of a person in the area, most especially if they had been searching or viewing the same merchandise the advertiser is selling.

        Then came the popular “geo tagging” games (which you can read about) but they all relied upon apps to do the gps work. Around 2005-06 mfg’s were putting out very sophisticated gps chips allowing phone providers to use civilian gps. But by the time the Sanford upgrade was underway, service providers were using military gps, so they had military accuracy which is just plus or minus 2 or 3 feet.

        I’ve done some more searching on e911 and I can see that the information we seek is being hidden away, they don’t seem to want the public to know just how much they can learn from gps or how they are capable of tracking whom. Well, I’ll let you in on a little research secret. (shusssh now don’t spread this around), whey you’re looking to discover system capabilities, and you can’t find good info on the net, go look in the company SEC filings. In their annual reports they love to brag about their systems capabilities.

      When the FBI released pictures of the two guys in Boston, it was said that they were going through phone records to pinpoint calls made during the time the younger guy was on his cell phone, so he could be identified. Technology is not good for folks who commit crimes.

      I highly suspect that GZ had no idea that the recording of the 911 call that captured the screens could be enhanced so his voice is detected cursing at Trayvon while Trayvon is begging for his life. He also had no idea of the tracking used by police dispatch.

      • Be reasonable, is a frightened non-violent 17 year old, really going to use abusive and controlling language on a bigger, heavier, stronger and angry adult? Probably not, most especially if the child isn’t fighting, and there is no evidence that the child ever had a superior anything on GZ. There needs to be some evidence of the child, at least displaying some level of confidence, approaching equality with GZ. That is no where in evidence because, if the child never uses his hands at all, he cannot have ever believed he was GZ’s equal at any point in time.

        Without any evidence of equality there is no possibility that Trayvon could or would have used abusive language, meant to control his opponent. The superior one uses the abusive and controlling language. The abused and beaten wife does not tell the abusive husband “shut the F**K Up” it just doesn’t happen ever!

        GZ thinks that we have to believe whatever he says, simply because we weren’t there. It never dawns on him that crimes can be solved, even if the police were not there when the crime was being committed.

    I cannot believe they would go to trial and halfway through or after he’s attempts to claim Immunity.

    Immunity if granted, would prevent trial. O’Mara is thinking ass-backgrounds by saying he is going to trial, but will roll the immunity hearing in with it.

    In a nutshell, O’Mara and West have no defense for GZ.

    • I have talked to more than a few lawyers and all of them laugh at this defense team. I was told this MUST have been done wayyyyyyyyy back in April last year. An Immunity hearing should have been filed so the Sword of Damocles is not hanging over anyone’s head minute more than need be.

      I swear I read that any Affirmative Defense would have to be at least so many days before trial as Nelson ordered a days.

      What part of the law don’t O’ Mara & West understand…….silly me…..I guess all of it.

    • @Brian. Who would use hollow-point bullets in a gun for personal protection? George Zimmerman, who intends to kill with one shot. Zimmerman has been very clear that he “aimed” before shooting. He didn’t shoot to warn or wound — he aimed for Trayvon’s heart intending to kill the unarmed 17 year old. He wanted no witness to his violation of law of pursuing and restraining. As Serino told him, GZ had no authority to do that.

          GZ was enjoying terrorizing Trayvon and wrestling to detain him, until Trayvon’s screams got the attention of residents who said they were calling 911. GZ was then “out of time.” As he told Hannity, he thought the police would arrive seeing him holding the gun and shoot him. He was terrified. He intended to kill Trayvon, aiming for his heart. Now, if Trayvon was straddle GZ with his thighs right next to the holstered gun, it would have been much easier for GZ to shoot from the hip wounding Trayvon in the thigh, than outright exposing the gun. If Trayvon could not get the gun off GZ’s hip, then what prevented him from wrestling for the gun after GZ unholstered it? Reasonably, because Trayvon never went for the gun and because GZ admitted to having Trayvon’s arm pinned when shooting him. That is not shooting in self-defense.

          GZ shall be convicted of second-degree murder and sentenced to life in prison. ShelLIE is also going to prison.
