Parkland School Shooting Victim Files Legal Notice Of Suit Against Local Government

By Tina Bellon (Reuters) – A lawyer for a student wounded in February’s mass shooting at a Florida high school on Monday filed a legal notice of intent to sue the county sheriff’s office and the school district for failing to protect the students. The lawsuit would be the first for the shooting at Marjory Stoneman Douglas High School in Parkland, Florida, in which a gunman killed 17 people and wounded or injured more than a dozen others.

The notice of intent to file a claim is required by Florida law before a lawsuit can be brought against government entities.

It would be brought on behalf of 15-year-old Anthony Borges and his family. Borges was shot five times during the massacre, suffering life-threatening injuries, and remains hospitalized, according to the notice.

“The failure of Broward County public schools, and of the principal and school resource officer to adequately protect students, and in particular our client, from life-threatening harm were unreasonable, callous and negligent,” the family’s lawyer, Alex Arreaza, said in the notice.

    He should also sue Rick Scott. He passed MANY, many pro-gun laws here in Florida. He’s only trying to backpedal after the Parkland shooting because he wants to run for Senate.

    Dear Xena,

    In the case of the Parkland Shooting, I like the idea of filing suit because this is one way to uncover data about what happened that otherwise would not become known.

    In the case of folks filing suits against retailers who raised the age where one can purchase an assault weapon, I hope the courts make the losers pay the attorney fees.

      Gronda,
      Those suing gun shops allege age discrimination. They are relying on state law that establishes the age to purchase guns. I don’t know if the law gives them a private right of action, so those cases are going to be interesting.

      About the lawsuit against the school and government, one question stays with me. Since the school knew about Cruz, how was he able to enter the school? There is some liability there.

    I am praying for Anthony. Yesterday, he underwent emergency surgery for an infection in his intestines and is back in ICU.

    Anthony is a hero who was shot as he held a classroom door shut, saving 20 students from the killer. We need our legislators to be just as brave and do the right thing by enacting safer gun laws.
