Ray Tensing’s Retrial Begins For The Killing of Samuel Dubose

Ray Tensing is a former University of Cincinnati officer who shot and killed Samuel Dubose during a traffic stop in 2015.  A mistrial was declared on November 12, 2016.  The straw poll by jurors was unanimous for murder.  After 25 hours of deliberation however, four jurors were ready to convict Tensing of murder, four were ready to convict him of voluntary manslaughter and four were ready to find him not guilty.  The jury consisted of 2 Black women, 4 White women and 6 White men.

Ray Tensing

Hamilton County Prosecutor Joe Deters said that how jurors went from unanimously agreeing on a murder conviction in their straw poll to being unable to reach a verdict on any charge is unclear.  He talked to the jurors and said that he learned a lot.

On November 28, 2016, Deter announced that he was retrying Tensing on the charges of murder and involuntary manslaughter.

The jury for Tensing’s retrial has now been seated.  It consists of 7 White women, 2 White men, 1 Black man and 2 Black women.

Opening statements are anticipated for this morning.  The trial is being live streamed at this link.    I’ll update in the comment section below.

    Crime lab tests on Tensing’s flashlight and boots showed no sign of being dragged, one witness said Wednesday.

    …In Tensing’s first trial, Prosecutor Joe Deters addressed the possibility that DuBose could, in fact, cause his car to move after he was shot.

    Dr. Karen Looman’s testimony wasn’t as definitive.

    “(DuBose) would have no thought or movement when the bullet hit his brainstem,” Looman said. “He was not in control of his body.”

    Toward the end of her testimony, Looman explained that DuBose’s body could have pressed down on the gas pedal.

    “If his foot was hovering on the gas pedal when he was shot, with gravity he would have collapsed on the pedal,” Loman said.

    When he was shot, the bullet entered DuBose’s head above the left ear and exited below the right ear, Looman said. That means Tensing was to the left and above DuBose when he shot him, Looman said.

    Yesterday, the prosecution rested. Today, they asked the judge to amend the charges to include a lesser charge of reckless homicide. Stew Mathews, Tensing’s attorney, immediately objected. Judge Leslie Ghiz rejected the motion. She said it’s the job of the prosecutor’s office, not the judge, to add criminal charges. Judge Ghiz said her decision would stand for now but could be reviewed once the defense rests.

    The first witness called by the defense was rejected and did not testify. The testimony was suppose to be about marijuana in DuBose’s system when Tensing shot and killed DuBose.

    My guess is that the jury (not being video experts) will not know whether to believe the prosecution video expert’s (Fredericks’) conclusions or the defense video expert’s (Roper’s) conclusions.

    • They will have to decide which is more credible, and which agrees with what they see on the videos. Common sense is that if I hear the firing of a gun before a car moves, that experts cannot tell me that the car was moving before Tensing fired his gun.
