Rocky Ford, CO – Shades Of Ferguson
Last Sunday, James Ashby killed 27-year old Jack Jacquez in Jacquez’s home. No one knows why Ashby came to Jack’s house. The Colorado Bureau of Investigation and the Rocky Ford Police Department have remained silent. That might be due to James Ashby being a police officer.

Jack’s family and friends say that he was shot in the back, but even that news did not come from the police but rather, from workers at the hospital where Jack was taken.
About 200 people got together in the small town of Rocky Ford, Colorado to protest, marching to the police station to get answers. Authorities aren’t talking to them. They are not even telling them what they are doing – but James Ashby is on paid vacation.
The protests pattern those in Ferguson. Yes, the nation and the world have embraced the reality that what happened to Michael Brown was wrong. “Hands up. Don’t Shoot” is being repeated in Rocky Ford, CO, and even Hong Kong, because of Michael Brown. Now, it is no longer Blacks who are marching while chanting “No Justice. No Peace.” People of every color are fed up that cops can kill, go on paid vacation, and authorities are silent, adding to the trauma and grief of victims’ families, friends, their communities – our nation.
People of all walks of life are coming together, but sadly it is because of death by cop.

On June 23, 2016, former Rocky Ford police office Jame Ashby who killed Jack, was convicted of second-degree murder in the 2014 slaying.

You can bet there will be those who will support the police, Jack’s FB page shows he used marijuana and because he isn’t ‘White White’.. As if that matters.
It shouldn’t matter. Marijuana doesn’t make folks violent. His family says the officer forced his way into the house, the hospital says Jacks was shot twice in the back. The family says they were pepper sprayed. Another officer given a paid vacation for having killed someone. This sh*t has got to stop. ( I wonder if the officer has a gofundme page yet)

Marijuana does not make folks violent. It mellows one out. Not that I am an expert. But seen a lot of people who smoke it. They are actually funny and laid back. Somehow someway we must put a stop to COPS killing just for the reasons they can. And it’s getting way out of control. I am white but still afraid of the cops here. They are corrupt as all get out.

This can happen to anyone of us, I know Shyloh. We had a case here in my little town where a woman slept in her car after the ‘bar closed down’ and for some reason just before daybreak walked across the street to a police sub station, approached 2 officers getting off their night shift and yelled something to them.
They immediately shot her dead, saying they thought she had a gun in her hand. Not another word was ever reported on this incident. The only family she had lived up north and didn’t pursue the details of her death. She had made FB posts through out the night about how great life was and what a good time she was having. Nothing seemed amiss. No one knew she even owned a gun, and most folks think she may have been approaching the officers to report a crime..

I wish that everyone could rediscover their humanity. Sadly, there are too many people who feel that a gun will solve all of their problems, and the SYG laws just add fuel to the fire.

I love Judge Healey’s statement on SYG laws here in Florida when he sentenced Dunn.. Saying it did not eliminate the responsibility to deescalate situations whenever one had the opportunity.

The “leaked” information gives Wilson’s story, but his story doesn’t explain why he got his butt out and fired at Michael, then shot and continued doing so until he blew Mike’s brains out. The “leaked” info is using the George Zimmerman playbook which essentially says “He hit me first so I pursued to get even, but it was in self-defense.”

Wilson getting out and firing at Brown is almost like Duuhhnnn getting out and firing at a red SUV.
The threat was gone and even if a cop is allowed by law to shoot, it’s only when the suspect is an immediate danger or a known / escaped felon. Wilson cannot claim he was still firing to “keep their heads down and prevent return fire.”
Wilson did not know about any alleged or real robberies and since none happened, lets keep it real and rule that out. Not only that, since when is it approved to shoot to kill someone who “stole” a few cigars ?? Never…..that’s when……never.
In NJ he’d have been arrested within 24 hours.

I read something (though quickly) that there are organized protests against Wal-Mart, but under the motivation of Justice for John Crawford. As far as knowing what Wal-Mart donates to whom or what, I would ask the person passing that info how that is known.

Right. There’s nothing validating the story. When it comes to companies, there is generally no way of knowing about their donations unless they issue a press release, or a corporate accounting. Even if a quarterly statement, that would not be due until the end of this month.
I’m also aware that some people pass bad information to impugn the credibility of the good-guys.

I’ve looked for a valid source all weekend and all I have found so far is the allegation originated from a Twitter Post from @70torinoman. If in fact they did and we have legitimate proof that they did, I will join the boycott of Wal-Mart as well. Has anyone actually seen any real proof of this?

I just went to that blog and looks as if they’ve taken that page down. And, I have a beef. Bloggers who don’t take time to write anything in the “About” are not dedicated bloggers. They simply want to get something up fast, quick, and in a hurry. If they don’t want an “About” page, they could at least delete it but they don’t take time to do that. That blog’s “About” contains Word Press’ instructions for what the page is for.

I’ve also ran into times when Word Press is doing “server maintenance.” Some of the time, the comment will still appear; sometimes not. It is aggravating.
The 9 hour time difference could be that they never set the time on their blog. There’s lots of pre-launch work that goes into Word Press if the blogger wants the blog to work well. The time set here on Blackbutterfly7 is CST. But, if that person’s Twitter also has a 9 hour time difference, they could be in another country, or even a small, undiscovered moon. LOL! Yep — a stirrer, just like 2 others, (one in Canada and another in New Zealand) who always have something to say about America’s politics and race relations.

The “server maintenance” was a first for me. I thought someone hacked my computer. You have to wait 5 minutes before touching anything or you’ll lose your message. So when I didn’t see my reply; I thought I hadn’t waited long enough.

I was going to post on this separately, but changed my mind. Ted Wafer is appealing his conviction. I can read the beginning of the brief now;
“Appellant should not have been convicted because he feared for his life and the person he murdered was drunk.”
Yeah — that should get his conviction overturned. (snark) The jury just didn’t see how AFRAID he was in his own house with the door locked before he opened it.

Xena, It would have been a bigger surprise if he had not filed an appeal! We’ll see same thing in the Dunn case as well. I have more fear of the Dunn case being overturned than the Wafer case, mainly because of the state the trial was held in… However, even with my conviction of the guilt of Wafer, I would not be totally in shock if the court ruled he had incompetent representation, time will tell…

Right. Appealing criminal convictions seems to be standard procedure. Unless the reviewing court finds something wrong with jury instructions, or that a judge sustained or overruled an objection that would the jury should have heard, it’s pretty hard to prevail on appeal. Now, even the ineffective assistance of counsel issue is difficult to argue. So many courts decide along the lines of, “You picked him. You live with the results.”

Hey, all – Lawrence O’Donnell is about to rip the NYT a new one again, tonight – about the Mike Brown murder. Honestly, I think the NYT deserves it again. They did a lame job with the so-called “new evidence” – just as bad as typical CNN, reporting it as it’s told to them, rather than analyzing what was told to them to see whether (1) it makes sense and/or (2) actually supports Dorian Johnson’s and other witnesses’ accounts more than (or at least as much as) the murderous cop’s account.
What a disappointment, the NYT report – they used to be, and to a large degree are, a cut above other journalists. But they SO BLEW it this time!

O/T (well sort of off topic!) This should create a situation in St Louis this weekend… Is this not a direct reaction to the demonstrations that have been occurring on a daily basis in the area? Is it actually an attempt to create a more hostile environment that already exists there? What is it that they actually hope to accomplish other than to further the hate a discontent that is already in the forefront? Will this be one of those “Gasoline meet Fire” moments? Stupidity versus anger, which will rule?

peni4yothot, IMO this has stopped being so much about Mike Brown as it is about control. Granted this blog and a few others is still focused on justice (to an extent), but over all many people on both sides of the issue are now using this as a means of controlling the various political agenda’s that they favor… Will an indictment stop or prevent turmoil? I don’t think at this time it would, even if there is an indictment and not a conviction then turmoil will soon follow… At this stage Wilson is simply a pawn in a game of virtual chess in which there will never be a winner, only losers… Face it at this time even if God came down from heaven and proclaimed Wilson either guilty of innocent, the ones who support the protestors would not accept that he was innocent and the ones who support Wilson would never accept that he was guilty…

Xena, While I was looking for information about another case over the weekend, I came across this PDF. It is on scribed.com and in your opinion is the content found on that site reliable and truthful or is it full of false and misleading information? I’ll give you a link to the information and you see what you think.
Allegedly this is the police report for the strong armed robbery that Mike Brown has been linked to. If this is true, why has no one on the Wilson side of the incident been shouting it from the roof tops?

Anyone with a scribd account can upload to that site. What it means is that the documents can and most times are real, but it doesn’t mean that the documents are for a legit purpose. For example, a cyber-extortionist uploaded his court pleadings to scribd. After a restraining order was entered against him, he had to take them down because the content was intended to post the personal information of, and demean the other person.
So, here’s the thing about the police reports; they are what the Ferguson police department has already said. With careful examination, you will find that there is no “victim”. The store’s owner did not call the police, nor press charges. The person who did call the cops was not a victim and lacks standing to file charges. It was the cop’s own discretion to file that report based on a custom’s call. They identified Mike Brown as the suspect after Wilson killed him.

Xena, Am I reading the portion of the report on the drugs wrong? Are the Delta 9 THC’s not an indicator of drug use? I really don’t think the use of drugs would be relevant to the case, unless some one thinks that the use made Mike Brown some sort of super human and can prove that… I must admit that I have very little knowledge of what the various terminologies used in this report mean, but a quick web search led to a site that indicates that he did have drugs in his system. It is quite possible that I, due to lack of knowledge about the subject am reading this data wrong?

Xena, Time out, after my last post, I went back and looked at the page on the PDF that listed the drugs and saw that it did indicate that he was tested positive for the use of Cannabinoids… again, I fail to see how this could fit into any realistic narrative of innocence or guilt on the part of Wilson.

Forgive me for not being detailed. Darren Wilson’s “spokesperson” put out a report that Wilson said Mike had to have been on drugs. That was in association with Mike purportedly bum rushing Wilson like a mad man. Actually, that type of behavior is unassociated with pot.
On the ME report, it has a category for “THC” that “impairs” and that category for Mike is “negative.”
In other words, the only thing that Wilson had giving him reason to continue shooting Mike until Mike’s brains were on the street, (cause he must have been on drugs</em) is not supported by the autopsy.

Xena, You did nothing wrong, as I said there was a possibility that I was not understanding the content of the report. As to the “Bum Rush” theory, IMO it is just that, a theory and at this point still not backed up by hard evidence. Thank you for taking the time to explain the different types of “THC”, not having any experience with the drug, as I admitted, I do not have enough knowledge of the effects to make a valid judgment of Mike Browns state of mind that could have been caused by drugs. I suppose a little more knowledge of the answer before asking a question is in order on my part… .

I wasn’t detailed to explain what I saw in the toxicology report. I neither have personal experience with pot, but for all the medical stuff we read during GZ’s murder trial, the consensus is that pot “mellows.” The impression from Wilson’s “spokesperson” is that Michael acted like he was on some drug that caused him to be violent, unable to feel pain, and be suicidal.

Unfortunately, though, if you believe these cops’ stories (and I don’t), it happens all the time! That is, every time a cop – or wanna be cop – kills an unarmed citizen. What BS.

Personally, I think that when Ofc. Wilson was sitting in his cruiser, he was aiming his gun at Michael Brown ready to shoot Michael. Michael might have grabbed at the tip of the barrel to try to move the gun direction away from his (Michael’s) body.
That is when Darren Wilson fired his gun from inside his cruiser. That is when Michael Brown’s hand was shot and hit by a bullet and that is when Michael started running away from Ofc. Wilson.
This is simply my speculation.

Dorian Johnson, in that first video (when Dorian was standing at his kitchen counter) recounted that Ofc. Wilson:
pulled his gun out, shot inside the car trying to hit him.

At most, there would only be an open palm print as he pushed Wilson’s gun away from being aimed at him from inside the cruiser.
I really have no doubt that Wilson had his gun out and ready to use as he back up his cruiser toward Michael and Darien.
