Civil Lawsuits Against Michael Dunn Settled

Congratulations to the parents of Jordan Davis and others who were in the vehicle with Jordan when Michael Dunn opened fire.

Blackbutterfly7 extends our thanks to John Phillips for his statement on this matter.  It dispels the misrepresentation by some who omitted the word “stipulation” when saying that the civil lawsuit against Michael Dunn was dismissed.

Attorney John Phillips sent a text to News4: “We made an offer to settle both cases against Michael Dunn – 1) the estate of Jordan Davis’ case and 2) the case of two boys we represent.  They accepted the offer in full.  We cannot disclose the offer at this time, but it resolved all civil suits in principle.”

Jordan Davis’ parents filed a civil suit against Dunn in January of 2013.  The lawsuit for wrongful death alleged that Dunn and his lawyers made several defamatory claims against Jordan and his friends.  Among those defamatory claims were that Davis and his friends had a gun; belonged to a gang, and destroyed physical evidence that proves Dunn’s innocence.  Davis’ family said they wanted to restore their son’s reputation.

Michael Dunn’s criminal trial is scheduled to start on February 3.   He is currently held in jail without bond.

    Interesting that civil suits in FL are often filed and successful before the criminal trials even start. Hats off to the Dunns.

        But Dunn is already receiving a plea deal (no death penalty) especially since he’s charged with one count of 1st degree murder and three counts of attempted first degree murder.

        Of course he’s going to roll the dice like Piglet and hope at least one bigot gets on the jury and the trial ends in a hung jury and he can get a plea bargain then, but all hell would break loose if Corey screwed up this one after her minions threw Piglet’s case.

  6. good to hear! in what seems to be a sea of oil-slicked personal injury attorneys, john phillips stands out as a good guy. like xena, it strikes me odd that civil suits get settled before criminal trials, but i’ll take this as a good thing. i believe the evidence against dunn (including his jail house communications) is strong. i will, however, be watching corey’s office like a hawk during this proceeding.

      Yes. To settle a wrongful death lawsuit before trial pretty much conveys that Dunn’s attorney is not going for SYG immunity. That train has left the station.

      Don’t know, but Dunn’s case may end up with a plea deal rather than trial.

  7. Tower flower, you picked up on that! Michael Dunn had zero money. Phillips did it for the pr. Believe me, he had soaked this case as much as he could. Watching how he tried to latch onto Trayvon’s case was pathetic.

    Google John Phillips and Univ of Alabama football team pay off. It’s big news in Alabama as college football players are forbidden to be paid. They have a pix of him giving a 10k check to one of the players.

    • I don’t know about Dunn being broke. The court denied his application for indigence. He has or had a business in IT.

      The settlement instrument could also provide that liens are placed on any income deriving from the case, such as interviews, books, films.

    • m1, time goes by fast. Dunn has been in jail for over a year. Let’s hope that his case doesn’t get continued. Each time that I’ve watched his police interview, it amazes me how he thought he shouldn’t be charged based on what he said was said to him. What little credibility he may have had drove off with him when he did and spent the night in a hotel. Had someone not taken his license plates down, the cops might still be looking for who killed Jordan Davis.

  10. wait a minute, am i the only one here wondering wtf is going on here?? they claimed Dunn & attny made defamatory statements about Jordan and his friends.
    who is the king of defamatory statements; georges zimmerman and his little dogs omara and west!!!

    the things they said about Trayvon, being a fighter, he attacked zimmerman, he beat his head into the concrete, was a hulking athlete that jumped out of the bushes et al. i don’t understand this?? what abt Trayvon’s reputation???? what about all those fake motions? accused him on TV of filming his friends beating a bum?
    this is so not fair. i don’t know abt defamation lawsuits but it’s really bothering how Trayvon is still not being defended by anyone really. No one’s been on TV defending his reputation. not only was he defenseless that night. the neighbors left him out there alone with that pig, the cops treated him like shit. not even crump is defending him anymore. but it really kills my that even the state failed to defend his right to his own life!

    btw, i found this today and wanted to know if anyone’s seen this: talking abt the witnesses who changed their story and state ignored it.

    • Shannon, my first thought is that attorney Phillips could add allegations of defamation to the lawsuit as it pertained to Dunn’s side of the story, because there are witnesses who can testify that Dunn’s version is not the truth.

      Although there is internet defaming of Trayvon, there’s no proof that Zimmerman said those things about him. What is seen in the 7-Eleven video, and Zimmerman’s claims of how Trayvon appeared “suspicious”, are best left for the feds to use if they charge Zimmerman.

      • of course you’re right. i get cranky whenever gz is quiet. i worry he’s not gonna get in trouble again. lately i’ve been upset abt the shit ppl keep saying abt Trayvon. i worry that history wont consider Sybrina&Tracy victims of a murder like the sandy hook parents. every time i see other parents of murdered kids and the deference they’re afforded it bothers me that Tracy&Sybrina arent’ getting treated properly by the whole country!
        i’ve been thinking abt the history of this case in the future. and i can’t stand the thought of the murderer not being publicly rebuked and punished. that just freaks me out to imagine them not getting the respect they deserve and Trayvon not getting respect.

          Please don’t shoot the messenger……but there has been a lot of speculation that Sybrina and Tracy didn’t pursue a wrongful death suit because everything in Trayvon’s past would come out, every little detail would be twisted and exploited to Z’s defense. It could be that they just don’t want that to happen and, like Xena, said damage “the legacy that is now defined by the good things.”

            i can’t imagine the Martins having anything to hide. they tried everything to smear Trayvon and his parents, they searched everywhere to find dirt and the worst thing they found was a couple of pics out of 1000s!
            this is a typical tactical threat to scare ppl out of filing suits but in this case we already know it won’t work because he’s already tried it in the criminal case.

            if you think about it, the defendant bringing up anything bad about a dead minor’s past, even tho the kid didn’t have a criminal history, would seem pretty stupid now to most normal juries. especially this particular defendant since now he’s revealed to the whole country what kinda asshole he is and was the night he killed his victim.
            and we assume zimmerman wld have to testify in order for him to defend himself in the civil case so imagine all of HIS history we can get into that is actually about his own aggression!

            I agree, like I said don’t shoot the messenger. Trayvon had some problems in school but not unlike so many other teenagers. Like I said it was only speculation from other blogs. While Z’s past can be proven, rumors about Trayvon would be harder to prove….as evident as hard as the CTH tried but couldn’t link anything to him, but I could still see Z’s lawyer twisting every photo and comment he ever had posted.

            Trayvon’s parents may just want to concentrate on the good being done now and not jeopardize what they have built with wild lawyer speculation.

            O’Mara has wiped his hands of Zimmerman. Do we really think there is another attorney anywhere in America that would represent Zimmerman in a wrongful death suit? As it now stands, we don’t know if Zimmerman has an attorney to represent him in the divorce.

            In context, that is not what I said as it pertains to a possible wrongful death lawsuit that raises allegations of defamation. Let me see if I can be more clear.

            Two things that I wrote:

            Trayvon needs no defense because his legacy is defined by the good things that are happening in his name. There are songs, films, scholarships, t-shirts, and there will be books. Those things will be around forever.

            The first pertains to a potential wrongful death lawsuit. The second pertains to Trayvon’s legacy.

            Dunn said dishonest things about Jordan, giving him an excuse to shoot at the vehicle. There are living witnesses to testify that Dunn is lying. Trayvon is the only witness who can dispute Zimmerman’s entire story. Trayvon is the only witness who can testify to the content of his phone records. Trayvon is dead.

            Zimmerman made statements about Trayvon, but unless he is hiding behind an internet identity, he did not allege that Trayvon was in a gang as Dunn alleged against Jordan. The thugification of Trayvon was attempted by Zimmerman’s lawyers to appease people that had promised to financially support Zimmerman. We can say without a doubt that O’Mara was expecting to be paid and the only means for that was through financial donations. At trial they were not allowed to enter any evidence in support of their thugification that they released to the public pre-trial.

            Because Zimmerman did not allege that he found Trayvon suspicious of knowing how to use MMA, or suspicious because of his phone records, those things would not be allowed by the court to be entered in a wrongful death civil case. Even if they were, the same will be allowed for the plaintiffs; i.e., they will be allowed to present Zimmerman’s training in MMA and phone records. That would include Adam Pollock’s videoed taped, post-trial statement that Zimmerman gave him credit for teaching him to “shrimp” saying that it saved his life. If MMA shrimping saved Zimmerman’s life, then killing Trayvon did not. (And remember those texts that Bernie said the State has where Zimmerman made statements about Tracy and “a reverend”?)

            The merits in such a case would be based on Zimmerman’s suspicions that caused him to follow Trayvon, first in his vehicle, then on foot, leading up to his meeting Trayvon face-to-face and killing him. Those merits are also what federal prosecutors will examine to decide whether to charge Zimmerman with violating Trayvon’s civil rights, as they pertain to Zimmerman’s state of mind before he killed Trayvon.

            I agree with Shannon. The only persons we have heard claiming that Sybrina and Tracy are not filing a wrongful death suit because they don’t want Trayvon exposed, are the same people who make up lies about everyone and anyone they want claiming to have “outed” them.

            Shouldn’t we be at the point where Piglet has to be deposed and forced to give his version of events that night?

  11. Xena, I am back, my 1st amendment rights are curtailed some what for now, so I am limited as to what cases I am allowed to discuss. This sucks, but until my attorney manages to get me a little relief I have to comply with the request that they have served on me. We have finally managed to regain access to my servers which allow me to connect to the Internet… shades of “1984” come to mind…

          On the serious side, these temps are brutal and more care is needed when going out. Just this afternoon I suggested to my son that he put extra clothing in the trunk of his car because he is over confident — still has military boots, socks and what I call the “collar, hand band, mask and hoodie combo.”

  12. What are the chances, that not one AA will be seated on this jury? I don’t think Dunn will be that lucky to get an all white jury in Jacksonville and, it shouldn’t have happened in Sanford but, the prosecutors and the judge allowed it to happen. the make up of the Fogen jury is exactly what the racist B******S in this country wanted and, they got it. I know money won’t bring back the life of Jordan but, hopefully those law suits have left Dunn with “NOTHING!”
