George Zimmerman Trial – Day 10

Koppelli’s Gym owner, Adam Pollack, was arrested in March 2013 for attacking a woman and threatening to cut her fingers and toes off.   Pollack testified today that George Zimmerman joined his gym in 2010 and began training in “grabbling” then switched to boxing.  He testified that Zimmerman was trained in how to get free from being mounted, and how to protect his face from punches.  Zimmerman did not advance quickly because he was obese and had no previous athletic experience.

      The defense also violated Florida Statute on witness sequestration.

        • The State asked Judge Nelson to strike Donnelly’s testimony due to discovery violations. They mentioned that Donnelly had sat in the courtroom during witnesses’ testimony. Judge Nelson gave the State time to find proof and she will hear the matter again in the morning.

          • @mindyme62. You got it. John Donnelley is a snake in the grass, and GZ is a potted palm. Funny. At the beginning of his case when GZ behaved like a potted palm, he went to jail and ShelLIE was arrested. Towards the end of his case, he sat like a potted palm again, knowing that Donnelley was disobedient to the order of the court. Maybe it’s prophetic that the jury will find him guilty of 2nd degree murder, sending him behind bars.

  2. I would like to have seen the prosecution ask Mark Osterman why he wrote in his book that Trayvon had both hands on the gun. To show yet another lie/version of Zimmerman’s story (ies) that ”changes with each retelling”. Force him to say that Zimmerman told him that or admit he just made it up. Kinda ruins the credibility of the book and it’s author.

At closing, the State is sure to recall the jury’s attention to GZ’s best friend’s version of “George Zimmerman said.” Hey — Adam Pollack didn’t do the defense any favors today, because his physical demonstration certainly showed that GZ’s gun could not be seen, neither reached with Trayvon purportedly mounting GZ.

  4. She did find that the jury can hear about the thc in Trayvon’s system at autopsy didn’t she, I could swear that’s what I heard her say but I read on FL that she denied that it could be heard.. Which one is it??

        • Just read where a news source tweeted the defense has changed its mind. Maybe they don’t want the State entering GZ’s laundry list of drugs in return.

    • Okay, I watched it again. The problem appears to be that the State’s position is that a toxicologist is not qualified to testify of the effects of THC in the blood. Judge Nelson said that she is allowing the testimony, but the State can object, cross-examine, and present a rebuttal expert. John Guy didn’t look happy when he walked away from the podium, so I suspect the State is going to find an expert witness to first address the lack of qualifications of a toxicologist on the matter, and then present testimony.

      The problem for the defense is that they will need to explain how GZ thought it was safe to get out of his truck and follow a person who he construed being under the influence of drugs.

        The State should use the Colorado dui laws for mj. The legal limit is set for 5ng/ml. Trayvon had 1.5 ng/ml in his system.

    Great job on Donnely. I noticed he was in the courtroom during Jane Surdyka’s testimony. Maybe a good idea to have Jane’s statement that she thought the screams came from a younger person, juxtaposed with Donnely’s statement that he had heard 250 lbs men squeel like a girl.
    Journalists in the room tweeted that at least one juror was wiping her tears away during Ms. Surdyka’s testimony.

    After your and Xena’s advice my posts were coming up, I posted several times yesterday night and it all was working fine, but today again I can’t post and I didn’t even shut off the computer or change anything from when finally, seeing it was working perfectly, and after preparing a note of gratitude for y’all, to post first thing today, I went to sleep.

    IDK, but it has to be something on the professors side, and I reckon it will be something to do with the spam guard, which, for some reason, is taking my comments as spam. I can’t contact the professor as I have no reply in my notifications from him to be able to answer to, and that’s the only way I can sometimes get a comment to go in. As professor is a paying member of WP he maybe able to get on to them and see what they can do, or check his spam settings and remove me from the list.

    Been there, done it, bought the T-shirt many times yesterday and it didn’t work (clear cache, re-boot, change browser etc). Then, after it had not been working all evening and without doing anything, suddenly last night, after you replied saying you had seen my comments, I tried it and it was working.

    As I said, I went to sleep leaving my comments posting perfectly, even from the main thread, because I am sometimes able to post as a reply in notifications to somebody’s reply to me.

    In any case, thanks so much, but if you see a comment from the professor could you please try and post him there, because I really think it has to be something to do with his settings, and if he can’t fix it, he maybe able to contact WP direct who maybe can. (I am going to post on Xena’s to see if my posts are accepted there.)

  7. this is very annoying, all this drawn out babbling is wasting the jury’s time. they are sitting back there for an hour wondering why.

    xena ppl are saying the state is throwing the case. if we think reasonably the state put on a very basic case. they showed what the witnesses *saw* , showed what gz said happened. and showed Trayvon’s family said it was Trayvon screaming..

    then at the end of states case omar promptly told the media that he didn’t expect the state to be done so fast, he expected a whole lot more evidence. as if he was actually confused..

    to me it sounds like what some have said, the state held back a lot of evidence. did they hold back FDLE detectives to rebut the defense? those types of witnesses are much more authoritative and decisive. they know the evidence didn’t match with gz’s narrative that’s why they charged him! why aren’t they explaining it to the jury! the SPD are pathetic excuses for detectives, they basically helped further gz;s idiotic story. we need real detectives!

    why can’t the state bring in a CLEARER copy of the 911 tape that helps the jury actually HEAR some of the words Trayvon was screaming? don’t they do that all the time?? it’s not changing the evidence it’s enhancing the evidence!

That the outcome has been predetermined and the jury hand picked to be able to say that 6 members of the fairer sex, women and mothers, finds him not guilty or guilty of a lessor charge. Sounds paranoid doesn’t it? But for the life of me I cannot figure out why the State is not introducing so much more…

    • @Shannon. HEY!!! The State gets a rebuttal case after the defense rests. Their focus is on proving GZ committed 2nd degree murder. It’s the defense who has attempted to circumvent motions in limini and introduce issues such as “malicious prosecution.” The jury is not charged to find. George Zimmerman is the person charged and on trial. The State is staying focused and although it is subtle, they are also proceeding so that GZ will have to take the witness stand.

  8. Here’s the most important consideration that the defense overlooked, it is why they should never have tried to dwell on the voice identification at all.

    Consider:

    1. There is absolutely no evidence that Trayvon attacked gz as he claimed.

    2. Because of one above, gz is left without any good reason for having been screaming as shown.

    3. At some point during all this screaming, gz draws his weapon and fires.

    Now, as a juror, picture yourself engaged in deliberations over this specific issue of screams and a fight. If you are forced to conclude that it was gz doing all this screaming, you cannot just leave it at that, you have to try to determine a reason for this action.

    What reason can you think of; that would cause a man armed with a drawn firearm, preparing to fire it and kill a helpless victim, to scream as though he were going to die?

    The only obvious answer is, to create a false impression that his life was being threatened, so as to justify the killing.

    Unless someone can propose how Trayvon was able to cause gz great fear and pain, without using his hands, one has to conclude that gz’s only reason for screaming like that, was to create a false image of danger to himself, to justify what he was about to do.

    I wonder if this would occur to the prosecution, so that they could offer this idea in their closing.

    My guess is it would terrify the defense!

    • @Lonnie Starr. Excellent analysis! There was a lawyer on HLN last night who said that if GZ was screaming, he was doing it to mask his actions and justify murder.

      The most powerful evidence for me is that the screams end with the gunshot.

      • Well the jury knows that gz isn’t claiming that he shot the kid because he got punched in the nose. He claims he shot the kid because the kid was killing him with a savage beating.

        There’s no evidence that the kid was administering any savage beating, so why did gz shoot him?

        The only possible answer is: Because he wanted to shoot him!

        So, if gz was doing the screaming and he wasn’t being beaten to death. the only possible
        reason for him to be screaming is to provide him with cover for his murder. So, either way gz loses because there’s no evidence that Trayvon provoked his screams.

        Of course, there is the more reasonable conclusion, that gz provoked the kids screaming then tried to steal the screams for himself.

        Omar’s trying to play the jurors for jerks, now they see that 20 to 30 blows is being reduced to five or six blows.

        All Bernie needs to do now is remind the jury that Trayvon had every right to believe that gz was a child predator pervert, seeking out young boys to torture, rake and kill. Because a legitimate NW would not act like a perverted hunter of young children.

He’s based the animation on out of court “evidence” and testimonies and everything is simply approximate… which what you could expect to get anyway.     • Omar and crew don’t seem to realize that when they ask all these convoluted questions, and poke and probe and keep twisting until they finally confuse the witness into making some claim they want. The jury sees and understand all of that, just the same as we do.

      They know that if a clever lawyer keeps after a witness, they’ll probably get some concessions. Omar has done this so many times, then taken a victory lap, the jury is
      tired of his antics and discounts whatever he says.

        • OMG, JN isn’t hindering the defence she is helping them sort it out ? She said she doesn’t have a trouble with parts of it ? WHAT ? How can she even contemplate letting it through. If the jury see an animation, that gives them something to fixate on so they will never consider other possibilities. Visual solutions work, but this is based on the defence’s theory… the fight starting where they say it started. I hope you are right Xena, it will be a tragedy if she let’s this in… the guy just repeated it again “atty consultation”…

          Noticed JN just pulled MOM up because of the inter witness / attorney discussions during witness sequestration, was the forensic included because I heard someone say the forensic instructed the CG guy on his “intended” testimony?

          • O’Mara and vanilla ice cream West led this witness to do the animation according to GZ’s re-enactment and John’s testimony. Judge Nelson really got interested in how the animation is not based on Good’s court testimony. O’Mara didn’t like Judge Nelson questioning the witness. Too bad!

Estimates emplacement T, assumes right hander punches with left, surreal transportation from T to John’s yard, Trayvon kneels by GZ’s side instead of straddling him as GZ says he did because otherwise GZ can’t get his gun… well maybe we should let it in for the State as showing what DID NOT happen!

  13. Xena, posting worked on PL’s and whonoze’s until 5:am Uk, this morning – NOT WORKING AGAIN on either, only working on you blog

    Can you post whonoze so he frees me again and tell him what you did, which seems to have worked more permanently, in case there is something he forgot. And please keep on trying to contact the professor with the problem and I will reply to as many as I can to do the same!

    I have checked with my broadband provider and my IP address is what they call dynamic, i.e. it changes every time I log into the internet, so not sure it can be that, or could it be it is BECAUSE it changes

    Would it help if I sent PL a donation would that get his attention… or flood him with 5c donations one after the other ? Everything is so automated that you can’t seem to contact anyone these days. DESPERATE I AM, DESPERATE

    • @gbrbsb. Having a dynamic IP address can be a problem and might be THE problem posting on Word Press blogs because approval is per IP address. There are folks who comment here from different computers and when they do that, any different IP address puts their comments into moderation.
